1. Zustimmung zu den Bedingungen

Durch den Zugriff auf oder die Nutzung der Quantum AI Trading Bot-Plattform („Dienst“) erklären Sie sich mit diesen Nutzungsbedingungen („Bedingungen“) einverstanden. Diese Bedingungen stellen einen rechtlich bindenden Vertrag zwischen Ihnen und der Quantum AI Technologies GmbH („Unternehmen“, „wir“, „uns“ oder „unser“) dar.

Wenn Sie nicht mit allen diesen Bedingungen einverstanden sind, ist es Ihnen untersagt, diesen Dienst zu nutzen oder darauf zuzugreifen. Die Nutzung dieses Dienstes ist dort nichtig, wo sie gesetzlich verboten ist.

2. Berechtigung und Anforderungen

Um unseren Dienst nutzen zu können, müssen Sie folgende Anforderungen erfüllen:

• Mindestens 18 Jahre alt oder volljährig nach den Gesetzen Ihrer Rechtsordnung sein
• Einwohner Deutschlands oder einer Rechtsordnung sein, in der unsere Dienste rechtlich zulässig sind
• Vollständige Rechtsfähigkeit zum Abschluss bindender Verträge besitzen
• Nicht von der Nutzung des Dienstes nach geltendem Recht ausgeschlossen sein
• Nicht auf staatlichen Sanktions- oder Verbotslisten stehen
• Während der Registrierung genaue, aktuelle und vollständige Informationen angeben

3. Account Registration

3.1 Kontoerstellung

Um auf unseren Dienst zuzugreifen, müssen Sie ein Konto erstellen, indem Sie Folgendes angeben:

• Gültige E-Mail-Adresse und Telefonnummer
• Staatlich ausgestellte Identifikation (Personalausweis oder Reisepass)
• Adressnachweis
• Bankverbindungsdaten für Ein- und Auszahlungen
• Alle zusätzlichen KYC (Know Your Customer) Dokumentationen, die erforderlich sind

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorized use
• Ensuring your account information remains accurate and up-to-date

3.3 Account Verification

We reserve the right to verify your identity and may request additional documentation at any time. Failure to provide requested information may result in account suspension or termination.

4. Services Description

4.1 AI Trading Bot

Our platform provides:

• Automated cryptocurrency trading using AI algorithms
• Market analysis and trading signals
• Portfolio management tools
• Real-time market data and analytics
• Educational resources and trading guides

4.2 Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• System upgrades
• Technical issues
• Force majeure events

4.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

5. Trading Terms

5.1 Automated Trading

By using our automated trading features, you acknowledge that:

• Trading decisions are made by algorithms without human intervention
• Past performance does not guarantee future results
• You retain full responsibility for all trading activities
• Market conditions can change rapidly and unpredictably

5.2 API Integration

When connecting exchange APIs:

• You grant us limited trading permissions only
• Withdrawal permissions should never be granted
• You are responsible for API key security
• We are not liable for exchange-related issues

5.3 Trading Limits

We may impose trading limits including:

• Maximum trade size
• Daily trading volume limits
• Position size restrictions
• Withdrawal limits

6. Fees and Payments

6.1 Dienstgebühren

Unsere Gebührenstruktur umfasst:

• Monatliche Abonnementsbühren
• Leistungsabhängige Gebühren (Prozentsatz der Gewinne)
• Transaktionsgebühren pro Trade
• Bearbeitungsgebühren für Auszahlungen

6.2 Zahlungsbedingungen

• Alle Gebühren sind in Euro (EUR) zahlbar
• Gebühren sind nicht erstattungsfähig, sofern nicht anders angegeben
• Wir behalten uns das Recht vor, Gebühren mit 30 Tagen Vorlaufzeit zu ändern
• Steuern fallen zusätzlich an und liegen in Ihrer Verantwortung

6.3 Zahlungsmethoden

Akzeptierte Zahlungsmethoden:

• Banküberweisungen (SEPA)
• Lastschriftverfahren
• Debit-/Kreditkarten (Visa, Mastercard)
• Kryptowährung (für anwendbare Dienste)

7. Risk Disclosure

7.2 Platform Risks

• Algorithm errors or malfunctions
• Connectivity issues
• Cybersecurity threats

We do not guarantee:

• Profits or specific returns
• Protection against losses
• Accuracy of market predictions
• Success of trading strategies

8. Prohibited Activities

You are prohibited from:

• Using the Service for illegal activities or money laundering
• Market manipulation or fraudulent trading
• Sharing account credentials or allowing unauthorized access
• Attempting to reverse engineer our algorithms
• Using automated scraping or data extraction tools
• Circumventing security measures
• Creating multiple accounts without authorization
• Providing false or misleading information
• Violating exchange terms of service
• Engaging in any activity that disrupts the Service

9. Intellectual Property

9.1 Ownership

All content, features, and functionality of the Service, including but not limited to:

• Trading algorithms and strategies
• Software code and architecture
• User interface designs
• Trademarks and logos
• Content and documentation

Are owned by the Company and protected by international copyright, trademark, and other intellectual property laws.

9.2 License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

9.3 Restrictions

You may not:

• Copy, modify, or distribute our proprietary content
• Use our intellectual property without written permission
• Reverse engineer or decompile our software
• Remove copyright or proprietary notices

10. Limitation of Liability

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the greater of:

• The amount you paid us in the 12 months preceding the claim, or
• INR 10,000

These limitations apply regardless of:

• The legal theory of the claim
• Whether we knew or should have known of the possibility of damages
• Whether the remedies fail of their essential purpose

11. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses arising from:

• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws
• Your trading activities and decisions
• Your negligence or willful misconduct
• Unauthorized access to your account

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

• Submitting a written request through our support system
• Withdrawing all funds from your account
• Disconnecting all API connections

12.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• We suspect fraudulent or illegal activity
• Required by law or regulatory authorities
• You provide false information
• Your account remains inactive for 12 months

12.3 Effect of Termination

Upon termination:

• All licenses granted to you will terminate
• You must cease using the Service
• We will close all open positions
• Remaining funds will be returned per our withdrawal procedures

13. Governing Law

13.1 Anwendbares Recht

Diese Bedingungen unterliegen deutschem Recht und sind in Übereinstimmung mit diesem auszulegen, ohne Rücksicht auf Kollisionsrechtsprinzipien.

13.2 Gerichtsstand

Für alle Streitigkeiten aus diesen Bedingungen ist ausschließlich das Landgericht Berlin zuständig.

13.3 Streitbeilegung

Streitigkeiten sollen zunächst durch Mediation gelöst werden. Falls diese erfolglos bleibt, erfolgt die Streitbeilegung vor deutschen Gerichten.

13.4 Verbraucherrechte

Diese Bestimmungen berühren nicht die Rechte von Verbrauchern nach deutschem Verbraucherrecht.
